Chez Cotton of Matthew Gold & Co, Michael Etienne of Garden Court and Dylan Morley, a freelance researcher/paralegal, discuss bringing a claim for damages for the parents of a patient receiving care at a mental health hospital, where abuse by staff was exposed in a Panorama undercover operation.  The claim was settled pre-issue using the Human Rights Act, in circumstances where the common law of negligence appeared to offer no remedy.  The case study gives an overview of both the practical and legal aspects of the matter from instruction through to settlement.
